Severance Pay Under the Press Labor Law

For a worker to be eligible for severance pay under this law, they must have been employed subject to the Maritime Labor Law, and their employment must have ended within the framework of this law. The law applies to all seafarers on any vessel flying the Turkish flag, whether on seas, lakes, or rivers. The employer may terminate the contract of a seafarer under the following circumstances: if the seafarer does not return to the vessel before it departs, if the employment is suspended due to reasons such as detention, if the seafarer exhibits behavior contrary to work and working conditions, if the seafarer does not act in accordance with maritime rules, if the vessel is taken out of service for more than 30 days, or if the seafarer has a disability or an illness that prevents them from working. Workers employed in any artistic or intellectual work for newspapers, and news and photography agencies published in Turkey, can benefit from this law. According to the Press Labor Law, workers must have served for at least 5 years in the profession to claim severance pay. A journalist whose contract is terminated is entitled to one month's severance pay for each year of service in the past period, equal to their last month's salary, starting from the date of termination. If a journalist has received severance pay once, any new severance pay when they start a new job is calculated from the new employment start date. In case of delay in severance pay, the journalist can claim their right with an additional 5 percent daily. Furthermore, according to the Press Labor Law, severance pay should be calculated on the gross wage.
